Welcome to Dreamsway ("we," "our," or "us"). By downloading, installing, or using our AI Video Generator mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use our App.
We may update these Terms from time to time. Your continued use of the App after changes constitutes acceptance of the updated Terms. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date.

The App uses third-party AI services (including Fal.ai) to process your content. By using the App, you acknowledge that AI generation may produce unexpected or imperfect results.
You must be at least 13 years of age (or 16 in the European Union) to use our App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
If you are under 18, you represent that you have your parent's or guardian's permission to use the App and agree to these Terms.
Our App uses device-based authentication. When you first open the App, we create an account linked to your device. You are responsible for maintaining the security of your device. We are not liable for unauthorized access to your account resulting from your failure to secure your device.
You may upload images from your device for AI video or image generation. You retain ownership of the images you upload. By uploading content, you represent and warrant that you own or have the right to use the content, and that it does not violate any third-party rights or our Acceptable Use Policy.
Content generated by our AI (videos and images) is created based on your inputs. You may use, save, and share AI-generated content for personal or commercial purposes, subject to these Terms and applicable law. We do not claim ownership of AI-generated content you create.
You may NOT upload or use the App to create content that:

You agree to use the App only for lawful purposes. You may NOT:
The App uses a virtual credit system. Credits are consumed when you generate videos or images. Credits can be purchased through in-app purchases via the Apple App Store or Google Play Store. Credits are non-refundable and have no cash value.
We offer subscription plans (e.g., Weekly Pro, Yearly Pro) that provide benefits such as additional credits and an ad-free experience. Subscriptions are billed through Apple or Google. You can manage or cancel subscriptions in your device's App Store or Play Store settings.
Refund requests for purchases must be submitted to Apple (App Store) or Google (Play Store). We do not process refunds directly. Please refer to the store's refund policy.
Free users may see advertisements (banner and interstitial ads) within the App. Subscribers receive an ad-free experience. Ads are provided by Google Mobile Ads (AdMob). By using the App as a free user, you consent to receiving advertisements. Our Privacy Policy describes how ad data is collected and used.
Our Property: The App, including its design, logo, name, and underlying technology, is owned by us or our licensors. You may not copy, modify, distribute, or create derivative works without our written permission.
Your Property: You retain ownership of content you upload. You grant us a limited license to process, store, and display your content solely to provide the App's services.
AI-Generated Content: AI-generated content created through the App is yours to use. We do not claim ownership.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. AI generation may produce unexpected, inaccurate, or inappropriate results. You use the App at your own risk.
TO THE MAXIMUM EXTENT PERMITTED BY LAW: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater. We are not liable for damages resulting from your use or inability to use the App, AI-generated content, third-party conduct, or unauthorized access to your data.
You agree to indemnify, defend, and hold harmless Dreamsway, its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses arising from your use of the App, your violation of these Terms, your violation of any third-party rights, content you upload or create, or your violation of any applicable law.
You may stop using the App at any time. We may suspend or terminate your access to the App at any time, with or without notice, for violation of these Terms, fraudulent or illegal activity, abuse of the service, or any other reason we deem appropriate. Upon termination, your right to use the App ceases.
Before filing a formal dispute, you agree to contact us to attempt to resolve the matter informally. These Terms shall be governed by the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
If you are accessing our App from the European Union, we comply with the Geo-blocking Regulation (EU) 2018/302. This means:
While we strive to provide equal access across the EU, certain features or content may be unavailable in specific regions due to technical limitations, legal requirements, or third-party service availability. Any such restrictions are based on legitimate, objective reasons and not on discriminatory geo-blocking practices.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App. If any provision is found to be unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver.
